KUALA LUMPUR, Feb 5 — The Perak Sultan’s decision today in asking for the Mentri Besar Datuk Seri Nizar Jamaluddin’s resignation and denying consent to dissolve the state assembly has become the subject of legal debate among experts here.

“The problem in Malaysia is that the law is not allowed to take its course,” Abdul Aziz Bari, a law professor at the International Islamic University told The Malaysian Insider this afternoon.

He explained that while it is the Sultan’s “prerogative” to say “Yes” or “No” to a request to dissolve the state assembly and pave the way for fresh elections, the Sultan should not insist on the resignation of his appointed MB until it is clear he no longer holds the majority support of the state’s lawmakers.

“I think the Sultan has made a mistake,” said Abdul Aziz.

He explained the need to clear the disputed status of the three assemblymen for Behrang, Changkat Jering and Jelapang who yesterday announced their support for the Barisan Nasional (BN) coalition after having left the Pakatan Rakyat (PR) coalition to be independents.

The Constitution is the highest law of the land. It is the foundation and source of legal authority, and the Rulers are sworn to protect and uphold it.

Acording to the Constitution, Dato’ Seri Nizar Jamaluddin is Menteri Besar until he resigns of his own accord, or is removed by a vote of no-confidence in a formal sitting of the assembly. The Constitution makes no provision for his removal by any other means, including by petitions or instructions from any other authority.

Hi brother. It was not so good step to actually choose and take people statement that can be used to just support your arguments but I agreed that it is not wise to take over the kerajaan negeri like that.

However.. since you mention that I didn't read Malaysiakini.. I read it everyday.. along with other onlinenews newspaper.. including Utusan. A neutral person will read all of them.

I can still remember what MB Perak and Anwar Ibrahim said during the lompatan Bota to PKR.

What did they said 2 weeks ago when things were going in favors towards them??

Dengan ini, kerajaan Pakatan Rakyat negeri Perak yang dianggota DAP, PAS dan PKR mempunyai 32 kerusi Dewan Undangan Negeri manakala BN 27 kerusi iaitu 26 Umno dan satu MCA.

Mohammad Nizar menyifatkan Nasaruddin, 58, yang juga bekas Pengerusi Felcra sebagai seorang yang beriman, berilmu dan berpengalaman.

All the praise goes to Bota that time. There were no arguments or no bantahan from Pakatan itself. At least in BN there were few voices that a bit unhappy (they were not trully go against this but they said there were another way to take over the kerajaan negeri).

1 more thing.. it is known to the public MB Nizar is a boneka MB in Perak. He couldn't play his role well in protecting the bumiputra rights in Perak.

This is the main and most important reason why even thou I didn't really agree with the way take over happened but I was relief that there will be new MB that will continue back to protect it.

Just for you to sit and think back the consequences in the long run.

kan itu yang saya kata, mereka bercakap itu dan ini, tapi yg melakukan perbuatan2 itu.

kan saya dh tulis Karpal Singh tidak setuju dgn lompat parti? DAP juga secara umumnya juga telah menyatakan ketidaksetujuan mereka.

saya dh tulis tentang pendirian saya dlm entry 2-buy elections.

don't talk about boneka/puppet. Malay's special rights are well protected in the FC. Even when all Malays are absolutely united or when the non Malays are too, there won't be any changes in the FC as it requires 2/3 of votes. Apa bukti anda kata dia tak boleh protect hak2 Bumiputra?

If you wanna talk about Malay rights, take a look at Penang. Dibawah pemerintahan BN lagi, jumlah pegangan Melayu x sampai 10% pun, dan anda pergi ke pulau pinang sendiri dan tgk la rumah2 melayu di situ.

apa hak2 melayu yang dh dibuang oleh PR?

berapa banyak pula yang telah dijual UMNO? jauh lagi teruk.lagi jelas.lagi nyata.
